The Silberstein Law Firm, PLLC, was founded in 2011 by David M. Silberstein, who has practiced law for over 36 years. For the last 30 years, he has provided advice to clients throughout Florida, including the Sarasota, Bradenton, and Lakewood Ranch areas of Sarasota County, Florida, and Manatee County, Florida, and Southwest Florida, from Tampa to Naples.  Offices are presently located in Sarasota, Florida, and Lakewood Ranch, Florida.

David is a Florida Bar Board Certified Tax Attorney and a Florida Bar Board Certified Wills, Trusts, and Estates Attorney.  He has held both of those Certifications since 1998, and is considered an expert in both of those fields of law by the Florida Bar.  David has been recognized as a Florida Trend Legal Elite Attorney for 2021 in the fields of Wills, Trusts and Estates.  He has also been recognized as a Florida Super Lawyer in Estate Planning and Probate continuously each year since 2006.

Our firm focuses on legal advice for personal and business life-cycle events, as well as some business transactions and real estate transactions.  We provide specialized advice in some probate and trust litigation matters.

Personal and business advice involves estate planning, wills, trusts, probate and estates, estate settlements, trust formation, administration and settlements, corporate, partnership and business law, tax law, and estate, gift, and generation skipping tax law.  We assist clients in planning for wealth transfers during life and at death (estate and gift tax planning), succession planning, preparation and review of various documents and techniques, including wills, revocable trusts, charitable trusts, life insurance and other irrevocable trusts, family limited partnerships, and the administration of trusts and estates after death (including probate).  We advise clients in asset and stock purchases and sales, mergers, and other business transactions.  Our practice further involves planning for the formation, acquisition, operation, sale and dissolution of corporations, partnerships, joint ventures, limited liability companies, limited liability partnerships, and limited liability limited partnerships.

We advise our clients on certain real estate transactions and related matters, and can provide advice in certain types of litigation involving probate and trust litigation.  We also represent our clients in various forms of alternative dispute resolution involving arbitration and mediation.  Our representation in disputed probate matters includes advice regarding settlement of disputed estates, proceedings to enforce wills and trusts, challenges to revoke wills and trusts,  and resolution of matters involving undue influence and estate planning procured through other methods including fraud.

Planning in these areas is personal to each client, requiring that we focus on each client’s personal and financial goals and needs in addressing the client’s legal needs.  Our boutique practice allows us to focus on specific areas of law to better serve you.  We work with each client’s other professional advisors, including certified public accountants (‘CPAs’), financial advisors, investment advisors, insurance agents, and realtors.  We are AV-rated by Martindale Hubbell, and involved in many state bar activities.
